Gillmore will not be charged for alleged threat

Impossible to prove criminal offense, officials say

Oregon State Police will not recommend criminal charges against a notorious serial rapist after fellow inmates allegedly overheard him threaten to slit the throat of one of his most vocal victims.

The investigators determined that because the alleged threat by Richard Troy Gillmore was overheard by inmate witnesses instead of by telephone, e-mail or in written form, as required by the statute, it would be impossible to prove a criminal offense beyond reasonable doubt.

“While it does not meet the legal threshold required for criminal prosecution, it is cause for deep concern for public safety,” said Paige E. Clarkson, Marion County deputy district attorney.

Gillmore allegedly said he would cut the throat of Tiffany Edens, 35, said her attorney, Jim McIntyre. Edens, along with the Multnomah County District Attorney’s Office, has fought for the past year to keep Gillmore behind bars.

Nancy Sellers, the parole board’s executive director, said the deliberations on Gillmore’s parole are still on hold. The board will wait and see whether the Oregon Department of Corrections pursues any sort of administrative sanctions for misconduct against Gillmore.

Multnomah County Deputy District Attorney Russ Ratto, who prosecuted Gillmore in 1986, says the board should have refused Gillmore’s parole long ago.

“The parole board has more than enough information to have decided this case months ago,” he said. “This continued delay is very unfair to the victims and is completely unnecessary.”

The alleged threat Gillmore made against Edens only proves that Gillmore “is capable of concealing violent thoughts and a propensity for violence,” Ratto said.
