A 14-year veteran of the Clackamas County Sheriff's Office resigned Tuesday over allegations that he inappropriately touched a female acquaintance who was riding with him while he was on duty.
The sheriff's office put Deputy Brandon Claggett on administrative leave on July 8 after receiving a report from the Department of Justice detailing the allegations.
"I can tell you it stemmed from an acquaintance, a female acquaintance that rode with him ... There was just an allegation of some inappropriate contact," said Lieutenant Kevin Layng of the sheriff's office.
Claggett primarily patrolled the communities along Highway 26 near the base of Mount Hood, including Sandy and Government Camp. He was a drug recognition expert and specifically targeted marijuana activity as part of his duty.
A criminal investigation was completed in mid-September and presented to the Clackamas County District Attorney's office. After reviewing the material, the district attorney declined to prosecute based on the evidence.
The sheriff's office then began an internal investigation, which was ongoing when Claggett resigned from duty. The sheriff's office said the internal investigation would be closed now that Claggett is no longer an employee of the county.
The only problem is, there are too many cops that still have their jobs despite their documented misconduct and even criminal arrests. Nobody has held those officers accountable....the question is, why not? Sometimes it is difficult even impossible to get a department to investigate a law enforcement official for something they have done illegal, unethical or immoral. Even the DPSST that licenses law enforcement officers in the state of Oregon declines to get involved unless the department where the officer works investigates the allegations first. Here is where the problem lies. If the department declines to investigate anything then it all gets white washed and shoved under the rug. This is why the cops who have been arrested for beating their wives/girlfriends, drunk driving, drug use, falsifying police reports, lying under oath, threatening citizens and using coercion to get what they want still have their jobs. On the other hand, if the administration in the department doesn't like the officer, or some of the command staff have a personal beef with the officer in question, you can bet an Internal Affairs Investigation will be conducted. Departments can investigate officers however they want. For example, if they investigate an officer who has had allegations made against him and they want to prove the allegations, they will go to the ends of the earth trying to make the officer look guilty, even if he has been falsely accused of something. This includes committing official misconduct, falsifying witness statements and police reports and using threats and coercion to get the responses they want out of people they interview regarding the case. If they want to clear the officer of all allegations, they will investigate the case in a manner that makes the officer look innocent of the accusations by neglecting to interview key people/witnesses and leaving certain statements out of police reports and totally disregarding certain aspects that could possibly incriminate the officer. This is the reality in law enforcement. Many officers that do commit true misconduct and where there is proof of this, deserve to lose their jobs and police certifications. However, it can and does happen to officers/deputies that truly have done nothing wrong, and despite the facts in the case like no evidence or proof the the officer engaged in the alleged misconduct, the Internal Affairs (IA) investigators will make every attempt to show the officer was guilty of something. Not surprisingly, some of these cases where IA doesn't prove any misconduct on behalf of the officer and has no evidence that the officer did anything unethical or illegal, still end the officers career due to personal vendettas and revenge from other officers and administrators. I just wonder when we are going to start holding the cops who still have a badge accountable for their misconduct and illegal behavior??

"Inside", has obviously done his homework and makes some pretty good points about how the system works. Unfortunately, much of what he describes I think can be ascribed to "human nature". It's kind of like all the terrible political & economic crap we have going on right now. We deffinately need more regulation and oversight but it's pretty tough to legislate morality.
I think it needs to be pointed out that this Claggett case is somewhat exceptional. Most of what "Insider" writes has been verified over and over in Clackamas County, time after time. I won't mentioning specific cases because there are too many, but anyone that reads the paper knows about case after case involving serious mis-conduct within the ranks of CCSO, and most of these violators keep their jobs. The Claggett case started off this way too with investigators trying to discredit witnesses and downplay the evidence of unprofessional conduct. They didn't want to lose this one and had already launched their typical spin and cover-up campaign to save him. Claggett was kind of their golden boy because of his work with the feds in helping bring all this drug war money into the county. Most people have no idea how much money comes into our county through these drug war programs, how ineffective they are, and how little they produce. They are in some ways much like the Iraq war. You have everone rushing to support a good cause that no one would dare speak out against politacally, while at the same time you have this undercurrent of overt corruption going on in the background with contractors, opportunist and sleazy parasites stealing millions in tax dollars.
But getting back to my point; The thing that made a difference and made this case different is that CCSO realised they weren't going get away with their old "business as usual". Those of us that followed this case kept the pressure on through letters to the media, the attorney general, state and local representatives, and anyone else that would listen. We made sure CCSO knew we were whatching and let them know that they weren't going to quietly sweep this under the rug.
Isn't it funny how these moral crusaders spending millions of dollars to protect the public from a relitivly harmless plant like marijuana have little to say about more serious crimes that really do undermine public safety, and effect us all.

While I guess we have to be thankful that Claggett is no longer out there and some (small measure, in my opinion) of justice has been served, I have to wonder why the DA chose not to prosecute this case and why Claggett was allowed to resign, rather than be fired.
Does this allow Claggett to retain benefits such as (even a portion of) a pension and does he get to keep his DPSST certification, thus allowing him to be hired elsewhere as a cop?
As "Charley" mentioned above, Lieutenant Kevin Layng's explanation that "there was just an allegation of some inappropriate contact" with "a female acquaintance that rode with him" greatly downplays the actual level and scope of harassment of a young woman by this long time veteran of the CCSO. This girl was not "an acquaintance," she met Claggett because she was the victim of a crime. He further victimized her by using his official position to harass and stalk her.
I have to agree with "Inside," this IS all a whitewash. And it's true, "if they want to clear the officer of all allegations, they will investigate the case in a manner that makes the officer look innocent." However, it appears CCSO has done him even one better. Claggett's guilty, so they've decided to not even bother to investigate this any further.
While I suppose that might be acceptable if this were an isolated incident, let's not forget (as both the CCSO and the media appear to have) that Sandy PD's own Bill Bergin has also been placed on leave pending investigation into his involvement in this sordid affair. So, I daresay, this is not just a problem with one rogue officer, nor is it limited to one agency. Why nix the investigation?
As "ECCW" alluded to above, there are too many cases involving serious misconduct within the ranks of CCSO. It's time for the Department of Justice to step in and do something.

Conspiracy!!!! CCSO is a great department with a lot of great deputies!!!! They do a good job of investigating their own and putting their own in jail when they have done wrong.. But keep believing it is a conspiracy while you are sitting at home and these fine men and women are out protecting you.. Don't call them when you need help if they are soooooooo bad..

How nice to see your golden words again. I've missed you. Nobody, in my humble opinion, get's at the heart of things as well as you do. You are so right about this still being a white-wash despite Claggett's resignation. Did anyone read the press release from CCSO? If I remember right, it doesn't even make a mention of misconduct. Kind of makes it sound like Claggett just decided to retire.
I have spoken with quite a few folks that share your curiosity. Why was Claggett not prosecuted? Does resigning allow him to keep his retirement and law enforcement certification? Was this another piece of work brought to tax payers by Steve Hyson, president of CCSO cop union? Will Steve Hyson and Clackamas County be liable if Mr.Claggett goes to work for another juristiction and victimizes another young girl in a far worse way?
If it's any consolation at all, I have a pretty good idea that there is going to be a prosecution against Bergin. As Insider points out, they do pick and choose who will get it and who will walk. As for the department of justice stepping in to investigate Clackamas County, I'm not sure if you mean OregonDOJ or the US DOJ. I in fact did send two letters to ODOJ Hardy Meyers requesting they take over this investigation and take a larger look at all misconduct in Clackamas County. He ignored my first letter and had his press agent send a "Blow Off" letter in resonse to the second. I think as Insider states, it almost takes an act of congress unless the county themselves initiates something. Does anyone out there really think that CCSO is going to be the initiator of an investigation focusing on them? Does anyone really think that the Oregon DOJ has any interest beyond maintaining the status-quo and keeping things exactly as they are?
Maybe it's wishful thinking but I keep hoping when Gerry Spence finally shows up, a lot of things are goint to come to light about the administration of law in both Clackamas County and the state of Oregon.

The DOJ they are referring to is most likely the Executive Office of Weed and Seed which funded Claggett's anti-drug efforts on Mt. Hood. Good work is being done on the mountain by citizen volunteers, and unfortunately, some of those good efforts will be overshadowed by Claggett and his Sandy PD sidekick.
There are bad apples on every tree, but that does not make the whole agency, or whole program bad. It just makes those who believed with their whole hearts they were doing good work victims as well. There is always a fine line between good and evil; love and hate.
And as far as the DA not prosecuting that is just a reality in 2008. While harrassment and stalking are disgusting, it is hard to prosecute on that because there is a high threshhold of evidence needed especially in conservative counties like Clackamas. The end result is a man in a uniform with the power to harrass is no longer a deputy, and it is unlikely he will be one anywhere in Oregon anytime soon. When an officer or deputy resigns, he or she has about 3 years to get another police job before the certification runs out.
For Claggett's wife' and children's sake, I hope he finds another line of work soon so he can support them. And maybe if he is lucky, his wife will let him stay in the house, go to church, and find a way to forgive his sins and move on.
And then again, maybe not.

Ooh, This doesn't reflect too well on all those that stead fastly supported Claggett and his innocence. It also relects poorly on those that spent countless hours with him at their home and in community organizations like Mt. Hood Coalition & The Pal Center. I wonder if Shirley Morgan is going to take all those news paper clippings down at the Pal center about what a community hero Claggett is now that his conduct as a preditor has been disclosed.
I wonder if local citizens are going to allow Shirley to maintain her position as head of MHCADC or the Pal Center now that it is clear what kind of person she was associating with and exposing our children to. This is way too serious of an issue to go without some serious investigation and oversight. We need to see a front page story and interview with some of those connected most closely to Claggett and Shirley Morgan and see what they have to say about this. Maybe it's time to find out how someone despised by most of her neighbors with little connection to our community was ever given control over anything. There have been so many concerns for years over the misconduct, dishonesty, extremist behavior, false propaganda and general weirdness & deviency of this group that maybe it's time for some accountability for those in our county and government that have been supporting these freaks.
Please talk to your local representatives and school administrators about keeping our kids away from the Pal Center and Shirley Morgan until there is full disclosure
about her relationship with Claggett and fitness as an administrator of publicly funded programs.

I agree with Margorie. A few bad apples don't condemn the whole bunch. I know quite a few decent people involved in fighting bad drugs like meth on the mountain, and even if they are sometimes a little naive, they are none the less well intentioned. I know I know I cant Claggett's actions against all the good People doing a good job at our sheriff's office anymore than I can hold those good members of MHCADC responsible for the actions of Shirley Morgan.

Claggett never or rarely went by the PAL Center. That Center is run by committed volunteers who retired as teachers, administrators and other civic servants.
If you have ever been around Claggett, you know he isn't much of a kid person (but he sure likes himself a lot). And while the charges against him are scarey, the actual rumors out there are more to the effect that this was just an affair that went bad and the woman (who is over 18) was smart enough to turn it into an IA complaint and potentially a case with the DA. In the real world, an affair gone bad is just that...sour grapes.
Also, Shirely does rub many people the wrong way, and maybe her methods are a bit unusual and maybe a bit paronoid when it comes to drugs, but the end result is an amazing resource center for youth and families that is being sustained not only by government funds but also by corporate support. That is amazing in a community where most hard-working people work 2-3 jobs to just make ends meet.
Oregon has a culture which accepts basic alcohol and drug use, and is especially tolerant of Marijuana which is why we allow medical marijuana and allow a high threshold before charging anyone. Shirley goes against this grain which a lot of people, especially people who choose to flee regular city culture and move to the mountain, don't appreciate.
This too shall pass. I, for one, can't wait to see what job Claggett gets next.

It isn't just the CCSO that has officers who have committed serious misconduct, even been arrested for crimes and still have their badges and DPSST police certifications in good standing. Sandy PD and Lake Oswego PD are just 2 departments that I personally know of where officers have been arrested for crimes they committed and still have their jobs, guns and badges! Outrageous I know, but "Insider" above sounds like someone who has been through the system or at least knows someone who has been through it. The sad truth is, there is no "standard of conduct" in law enforcement. DPSST allows police chief's to conduct operations within their respective departments however they chose to do so and if that includes keeping the bad apples on board, then they do. All too often, many of these officers keep their jobs because they are friends with higher ranking officers or administrators or they have dirt on somebody. All needs to be kept quiet so as to not get the "news media" involved because then they might have to take action. Law enforcement has become so demoralizing and DPSST is no more than a tool for police administrators to use at their disposal. I think it should be made public knowledge every police officer that has ever been arrested for anything that is still on the job. Print their mug photos and what police department they work for so that the public can see how "ethical" our cops really are.

Don't know what rumors you've been hearing out there - Mr. Thatcher - or who started them (that's the beauty of never having an internal investigation, or releasing details of the criminal investigation, no?) but the rumors I have been hearing do not support your allegations.
But let's forget rumors, shall we? We can go back and forth like that til doomsday and not get anywhere. Let's look at what little facts we do know from the limited information that was released by the CCSO and others directly involved in the case - the horses' mouths, so to speak:
You claim the young woman "was smart enough to turn it (an affair that went bad) into an IA complaint and potentially a case with the DA."
Yet, this case only proceeded because, according to the previous Post article, "Oregon City business owner Jim Smith was confronted with some allegations against the deputy." He then "hired Newport-based private investigator Harold Nash to interview" the "young lady from Sandy" who "didn’t feel comfortable coming to the police". Nash — "a staunch supporter of law enforcement" said, "due to the outcome of the interview, I felt that I needed to forward it. I just did the interview and handed everything over to the Department of Justice." DOJ Spokesman Jake Weigler said, "The Department of Justice received Nash’s information July 8 and immediately passed it on to the Clackamas County Sheriff’s Office."
Sorry, Mr. Thatcher, but in light of the recent spat of incidents involving law enforcement and their illicit extra-curricular activities (see: Chief Foxworth and Sheriff Giusto) I don't believe so many credible, reputable people would involve themselves if this were simply a case of a young, unrequited lover seeking vengeance. I also don't see a 14-year veteran, Mr. Golden Boy, retiring quietly if he did nothing wrong.
Please stop victimizing this poor young woman even further by attempting to sully her reputation with such unsubstantiated and illogical rumors.

Thanks for your comments. Though I should mention, in case you are not aware of it, that what the cases and departments you mention all have in common is that they are all represented by Clackamas County Peace Officers Association. Their president, Steve Hyson was arrested last year for assaulting his wife in Vancouver. He still works as a detective for CCSO and like to brag about getting fellow officers off easy in disipline cases.

You are obviously well educated in the workings of Shirley Morgan and Ex-Deputy Claggett. My family was at one time a great supporter and volunteered many hours at the PAL center and other fund raisers. We have seen and had first hand experience of Claggett's antics and Shirley's undying support of him. We asked many questions and never received adequate answers. In fact we were treated as if we had no right to question Shirley's ultimate authority. Once we realized the extent of the lack of accountability and transparency we quickly removed ourselves from any association with these programs. While we still believe there is a great need and the Coalition could have filled these needs. My family will not be a party to these programs until Shirley Morgan has been removed.
As for Claggett I have heard what I would consider many stories of his misconduct and criminal behavior. I am very disappointed in the DA's decision not to prosecute. He and others like him are an embarrassment to the law enforcement profession.

Thanks for your comments & confirmation about this terrible situation on the mountain. You are one of the majority that support an anti-drug program but do not support having it under the control of an extremist tyrant. Many of us supported the Coalition and Pal Center till we ran head on into Shirley. There are so many normal well intentioned people out there more qualified than Shirley to represent the public.
It's a lot like the situation we had going with the Villages up here. One person with an agenda was trying to have total control over the whole show until they were stopped by good citizens paying attention. We need people like you and we need our School teachers, business owners, community leaders, and churches to all contact the Federal WEED and SEED office and ask that they remove Shirley Morgan from her position. Lets see if the feds are really interested in supporting communities and their members or if Shirley is just a schill for another government program out of touch.

I appreciate the kind and positive spirit of Matthew. I also appreciate that Matthew seems to actually have a pretty broad perspective on this situation that relates to the cultural climate of the mountain and Shirley Morgan. What I can't appreciate is his denial of some very real facts and serious concerns. Matthew almost sounds like another one of the spin doctors at CCSO when he tries to simply dismiss Claggett's behavior as "an affair gone bad". Claggett had a long and well known history of using his position to aid in stalking young girls that in no way welcomed his advances. The young girl in this case was a "minor" when she first became the victim of pictures and lewd, suggestive text messages. Those of us that know a little about this case know that it wasn’t any kind of affair at all as Matthew states, and that it went way beyond the bounds of normal decent conduct. Claggett's conduct in this case as well as his history makes him out very clearly to be a sexual predator.
A kids center sponsored by a police association is no place for someone with a history of being a sexual predator. Claggett wasn't just someone who popped in and out occasionally. He was a close personal friend of Shirley Morgan and he was the center piece of this whole Weed and Seed program. His picture and newspaper articles are plastered all over this place you claim is such a wonderful place for kids. This certainly isn’t the first case that has rallied the community against Claggett and Morgan. These two were directly involved in a very seedy excessive force investigation on the mountain a few years back that had many residents taking the long drive to Oregon city in hope of seeing justice for this pair.
Anything the Pal center does towards the end of providing real drug prevention education and a safe haven for kids is fine me and most people I know. My main point is that Shirley Morgan's whole involvement in this or any other program is totally invalid because of how she came to manage these programs through manipulation and deceit. Shirley's neighbors can all tell you about going to the first coalition meeting on the mountain. This was supposed to be a meeting for organizing an anti-drug program around community needs and goals. This Meeting should have been where the process began of selecting leaders and administrators, and structuring an organization. The fact is that this whole phony program had already been hatched up and put together in backrooms somewhere and Shirley Morgan was already in charge. Shirley was involved in this corruption from the start and it never was a grassroots or community based program.
Matthew also simply tries to let Shirley off as being somewhat the eccentric paranoid and someone that go’s against the grain. This is another huge departure from reality begging to spin the truth. Shirley is considered an extremist nut that has victimized most all of her neighbors throughout the years in one way another. She has also harrassed many respected businesses and citizens around the mountain. Shirley has no business being in charge of any program, let alone one that deals with kids or human beings.
Shirley has shown herself to be an extremist ideologue and fanatic zealot that is out of touch with the community she lives in. The Pal center may have started out with good intentions and good people but under Shirley's guidance has ended up becoming little more than a political pro-cop propaganda center serving up the some of the federal governments worst programs. I say turn this over to a responsible community member whose interest is truly the kids and not the support of an extreme political agenda. Maybe we can actually find someone like a school teacher or someone with a family and experience raising children to administer the Pal Center that will operate it with more of an eye towards serving the community.

Below is just one of the post that came into the Sandy Post July 25th scolding them for being so unfair to Deputy Claggett. Wonder how Danielle and Bobby, or their friend Lloyd Woods feel now. Gee, it must be embarrassing and humiliating to be so wrong. Poor Lloyd must be absolutely devastated.

I have known Brandon Claggett for about 10 years and out of that he is a great person. I cannot beleive that the Sandy Post would publish this story on the front page of their paper, out of this everyone that I know will be cancelling the Sandy Post.You must have nothing else to write about Claggett, when only a hired private investigator says he acted inappropriate well as far as I am concerned that is only his opinion ,until he was charged there should have never been a "front" page story where everyone knows him. Also, it seems like the Sandy Post has a lot of questionable items they hear things from a third party, write a story or an assumption and then have to rewrite the truth. If you are going to name an active member of our community then you should name the woman that supposedly accused him.
He is a huband, son and father in fact he has raised his son by himself for a very long time. He and his wife are both active members in our community and I find it ridiculous that on the same front page you critisize Claggett and then show his wife as a Chairwomen for Sandy Relay for Life. I feel horribly for the Claggett family.
We will stand behind Claggett and his family any day of the week he is a wonderful officer and we are proud to have him in our Community.

brandon claggett spent 14 years of his life protecting the citizens of clackamas county from low lifes and criminals . his job was one of the most risky and dangerous in law enforecement because he was known by the criminal element to have a specific purpose, keep the dealers and criminals from profiting and spreading their drugs into the community. because of that he earned many enemies...most of whom stood to lose something if he was successful.
no one is defending his lack of judgment in this situation. he is paying for that with the loss of his job. but the good citizens of the county should also not forget what he has done for them in the past...at any time he could have and would have taken a bullet to keep your homes and neighborhoods safe.
only those who have little respect for law enforecement in general will try and tar the entire department or law enforcement system with clackett's lapses.
i admire the man for the courage he has shown in his career, and i trust that those who are truly compassionate will eventually forgive him for his human

Oh no, another idealogue that can't tell right from wrong. We have plenty of capaple officers out there that are perfectly capable of being professional and ethical and doing what we pay them to do. Don't give us this hero business about Claggett. It's all in black and white Lloyd. We know who you are and how much you resemble the sheep that threw women and children into the furnaces in Germany. You are a pathetic coward trying to hide behind the shirt-tails of those with authority. It's pretty simple psychology. You are to guttless to think for yourself or stand on your own principles so you seek refuge with the mob.
Please don't confuse Claggett for being any kind of hero. I'm sure he did some good during his 14 year career, but it is far overshawdowed by how he misused the authority we entrusted in him. Society and law & order work best when citizens can respect those that wield authority. This is someone that should have been weeded out a long time ago for having weak character and a pention for abusing authority.
Statistics show that we the public are aften in more danger from law enforcement than we are from the crimminal element. Thank god for the good cops out there protecting us from dangerous felons that prey on the weak and innocent, and thank god for those that know the difference between the good ones and bad ones.

Patrolling the mountain and locking up an occasional dope smoker or petty criminal hardly qualifies as dangerous duty. Indizen almost sounds like one of those con artist getting paid to spew government propaganda and lies in support political rhetoric about how the war on drugs is working. : meanwhile, those that aren't morons kick this off just as we do "Joe the Plumber". More lies from from the desparate criminal element fighting to hold on to their economic advantage over those they enslave.

Get a life you pathetic loser. No one supports or wants a disgusting, pervert, predator lurking around looking for little girls while being paid to protect us from others like him. You are sick.

The saga of CCSO Claggett is not going to go away anytime soon. Little has been made public by the CCSO PIO about years of information provided to the Sheriff's Office of Claggett's criminal acts and sexual stalking of underage girls in the Sandy area.This information had also been provided to the Police Chief of Sandy by one of his reserve officers years ago.
Just because Claggett resigned and the Clackamas County DA did not prosecute him for his sexual stalking of one young girl doesn't mean that he is scott free from criminal charges being brought against him in the future. Some crimes he allegedly has been involved in doesn't have a Statute of Limitations.
In addition,His underage victims have very good civil lawsuits against him and the Sheriff's Office should they decide to pursue claims.

Thank God and Greyhound he is gone. This is a victory for everyone that believes in accountability and holding public officials to an acceptable level of ethical conduct. This article makes no mention of the inapropriate pictures and text messages sent to this young girl that helped make up this case. To be sure, everyone that serves in law enforcement most likely becomes the target of unfair and untrue accusations at sometime in their career. Only those guilty of these accusations end up resigning.
Too often here in these post we hear people like the former editor of the "Old Sandy Post" accuse anyone that stands up against unprofessional or unethical conduct of being cop haters, or felons with an axe to grind. It simply isn't true. Objecting to double standards does not make a good citizen a felon or a cop hater. Wanting to hold those that serve in law enforcement to a standard of professional conduct that honors and upholds the profession is not being a cop hater either.
A big thanks to everyone out there that stood up to this challenge to civility and decency for sticking with it and seeing it through to a just and fair conclusion. For those of you that blindly defended this conduct and claimed that those with authority are always right, shame on you. You were as wrong about this case as you are about thinking that hiding with the mob behind a shallow & false sense of values will protect you from the light of truth.
